Terms of Service
Last updated: May 18, 2026
1. Acceptance of Terms
By downloading, installing, or using the Frequentor mobile app or visiting frequentor.com ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old to use Frequentor. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate.
3. Account Types
Frequentor offers three account types:
- Customer ("Frequentor"): Follow staff, discover venues, write reviews, and receive shift notifications.
- Staff: Create a professional profile, link to venues, clock in/out, post vibe checks, and build a following.
- Venue Owner: Claim and manage your venue listing, view analytics, and manage your team's presence on the platform.
You are responsible for maintaining the security of your account credentials.
4. Acceptable Use
You agree not to:
- Create fake accounts or impersonate other people
- Submit false reviews or manipulate ratings
- Use the platform to harass, stalk, or threaten other users
- Attempt to circumvent GPS verification for reviews or check-ins
- Scrape, crawl, or data-mine the platform without written permission
- Use the platform for any illegal activity
- Claim a venue you do not own or manage
- Upload content that is obscene, defamatory, or violates others' rights
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
5. Reviews & Content
Reviews submitted on Frequentor are verified through GPS location data. By submitting a review, you confirm that:
- You were physically present at the venue
- Your review reflects your genuine experience
- You grant Frequentor a non-exclusive, royalty-free license to display your review on the platform and on staff/venue profile pages
Vibe check photos, profile photos, and other content you upload remain your property, but you grant us a license to display them on the platform.
Verified Content Retention
Reviews, vibe checks, and visit-verified articles submitted by Frequentor users are the property of the submitting user and are published at their direction. Venue operators may not suppress, delete, or request removal of user-submitted content about their venue, whether during or after their Frequentor subscription. Frequentor reserves the right to retain and display verified user-generated content for the integrity of the platform record. Venue operators who terminate their subscription acknowledge that verified content about their venue remains published per these terms.
6. Location Services
Certain features require location access:
- Staff auto clock-in: Uses geofencing to detect when you arrive at a linked venue
- Customer check-ins: Records visit duration at favorited venues for analytics
- Review verification: Confirms physical presence at a venue
- Silent check-in: Background geofence monitoring automatically records visits at participating venues to award loyalty points, even when the app is closed. You can disable this in app settings.
Location data is processed as described in our Privacy Policy. You can disable location access at any time, but location-dependent features will stop working.
7. Loyalty Program
Frequentor awards points for venue visits detected via check-in or geofence. Points have no cash value and may expire or be modified at our discretion. Venues may offer rewards redeemable with points — fulfillment of those rewards is the venue's responsibility, not Frequentor's.
8. Promotional Notifications (Seat Boost)
Venues may send promotional push notifications to customers who have previously visited. By checking in at a venue, you consent to receive occasional promotions from that venue. You can opt out per-venue or globally in app settings.
9. Occupancy Data
Some venues use Frequentor hardware sensors to estimate real-time occupancy. This data is anonymized and not linked to individual users. Busyness estimates are approximate and Frequentor does not guarantee their accuracy.
10. Venue Claims
Venue owners can claim their venue listing on Frequentor. By claiming a venue, you represent that you are the owner or an authorized manager. Frequentor reserves the right to verify venue claims and revoke claims that are fraudulent.
11. Payments & Subscriptions
The core platform is free. Frequentor Premium and Staff Pro are coming soon as optional in-app subscriptions through the Apple App Store; the paid venue tiers are optional subscriptions billed through our payment processor. Pricing, availability, and features of paid tiers are subject to change.
For the Hire marketplace: staff set their own rates. Frequentor charges event hosts a booking fee. Staff keep 100% of their quoted fee.
12. Intellectual Property
The Frequentor name, logo, and platform design are our property. You may not use our branding without written permission. The platform's source code, design, and algorithms are proprietary.
13. Disclaimer of Warranties
Frequentor is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, accuracy of venue data, or the conduct of other users. We are not responsible for interactions between users that occur outside the platform.
14. Limitation of Liability
To the maximum extent permitted by law, Frequentor's liability is limited to the amount you have paid us in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.
15. Termination
You can delete your account at any time by contacting admin@frequentor.com. We may suspend or terminate accounts that violate these terms. Upon termination, your right to use the platform ceases, but sections of these terms that should survive (liability, IP, disputes) will continue to apply.
16. Governing Law
These terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Harris County, Texas.
17. Changes to Terms
We may update these terms as the platform evolves. Material changes will be communicated through the app or email. Continued use after changes constitutes acceptance.
18. Live Translation (Mode B) Conduct & Appeals
Frequentor offers a Live Translation feature that lets a checked-in customer and an on-shift staff member at the same venue exchange messages in different languages. The feature is presence-gated — the live channel exists only while the customer is checked in and closes automatically when their check-in ends.
By participating in a Live Translation conversation, you agree:
- Not to use Mode B to harass, threaten, intimidate, or send sexual content to staff or customers
- Not to use Mode B for spam, advertising, or commercial solicitation outside the venue context
- That every message runs through AI moderation; messages flagged as hate speech, harassment, sexual content, threats, or spam are blocked before delivery and the sender is shown the reason
- That your venue's owner can review the conversation history and the moderation log for their venue at
/venue/<venueId>/conversations - That venue owners can appeal a block via the same dashboard if they believe the moderator was over-cautious; an appeal flips the message status from blocked back to allowed and the recipient then sees it
- That repeated violations may result in temporary or permanent removal from the Mode B feature, and serious violations may result in account termination under §15
For moderation-related questions or to flag a conversation, email admin@frequentor.com.
19. SMS Terms
By opting in to Frequentor text messages, you agree to receive a one-time verification message and recurring notifications (such as staff shift alerts) at the phone number you provided. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time; reply HELP for help or contact us at https://frequentor.com/contact. Carriers are not liable for delayed or undelivered messages.
